By accessing or using VestaBuilder ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

VestaBuilder is a construction project scheduling platform that enables general contractors and builders to manage task schedules, assign subcontractors, and send automated SMS reminders. The Service includes a web-based dashboard and SMS communication features powered by third-party providers.

3. Account Responsibilities

• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when creating an account.
• You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

When using the Service, you agree to:

• Only add phone numbers of subcontractors who have an existing business relationship with you.
• Use SMS features solely for construction scheduling purposes — not for marketing, advertising, or unsolicited messaging.
• Comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA).
• Not attempt to access other users' data or circumvent security measures.
• Not use the Service for any illegal or unauthorized purpose.

5. SMS Terms

• SMS messages are sent to subcontractors on behalf of the general contractor using the Service.
• You are responsible for ensuring that subcontractors you add to the platform have consented to receive scheduling-related messages.
• Recipients may opt out at any time by replying STOP to any message.
• Standard message and data rates may apply to SMS recipients.
• We are not responsible for SMS delivery failures caused by carrier filtering, invalid phone numbers, or recipient opt-outs.

6. Data Ownership

You retain ownership of all data you enter into the Service, including project details, task information, and subcontractor contacts. We do not claim ownership of your content. You grant us a limited license to process and store your data as necessary to provide the Service.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any damages resulting from service interruptions.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to missed scheduling communications, project delays, or data loss.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Service. You may cancel your account at any time by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify registered users of significant changes via email.
